New Roads Health Privacy Policies & Terms of Use
These terms and conditions of use (“Terms of Use”) govern your use of our websites, apps, or social media pages owned and controlled by New Roads Health, LLC including www.newroadssuboxone.com (collectively, the “Site”), as well as the Services (as defined below) and products (“Products”) available to users through the Site.
1. Terms
By accessing this website, you are agreeing to be bound by these website’s Terms of Conditions of the Use of the Site, Services and Purchase of Products, all applicable laws, and regulations, and agree that you are responsible for compliance with any applicable local laws. By using the Site, Services, or Products in any way, you acknowledge that you have read, understand, and accept all terms and conditions contained within these Privacy policies and Terms of Use. If you do not agree with any of these terms, you are prohibited from using or accessing this site. The materials contained in this website are protected by applicable copyright and trademark law.
2. Services
The professional medical services (which are provided by your Provider) and the non-clinical Site services (which are provided by New Roads Health & other Non-Clinical Staff) are collectively referred to in this Terms of Use as the “Services”. The terms “you” and “your” means you, your dependents if any, and any other person accessing the Services or our Site.
Your interactions with the Provider via the Site are not intended to take the place of your relationship with your regular health care practitioners or primary care physician. Neither New Roads Health, any of its subsidiaries or affiliates, nor any third party who may promote the Site or Service or provide a link to the Service, shall be liable for any professional advice obtained from a Provider via the Site or Service, nor any information obtained on the Site. New Roads Health does not recommend or endorse any specific Providers, medications, products, tests, or procedures. You acknowledge that your reliance on any Providers or information delivered via the Site or Service is solely at your own risk and you assume full responsibility for all risks associated herewith.
The content of the Site and the Services, including without limitation, text, copy, audio, video, photographs, illustrations, graphics, and other visuals, is for informational purposes only and does not constitute professional medical advice, diagnosis, treatment, or recommendations of any kind by New Roads Health. You should always seek the advice of your qualified healthcare professionals with any questions or concerns you may have regarding your individual needs and any medical conditions. All information provided by New Roads Health, or in connection with any communications supported by New Roads Health is intended to be for general information purposes only and is in no way intended to create a provider-patient relationship as defined by state or federal law.
Emergency
New Roads Health’s Site and Services are not for medical emergencies or urgent situations. You should not disregard or delay seeking medical advice based on anything that appears or does not appear on the Site.
If you are experiencing a medical emergency, you should dial “911” immediately. If you are having thoughts of suicide, please call the National Suicide Prevention Lifeline (1-800-273-TALK (8255) or 988.
You should seek emergency help or follow-up care when recommended by a Provider or when otherwise needed. You should continue to consult with your primary provider and other healthcare professionals as recommended. Always seek the advice of a physician or other qualified healthcare provider concerning questions you have regarding a medical condition before stopping, starting, or modifying any treatment or modification.
Telehealth
Telehealth involves delivering healthcare services using electronic communications, information technology, or other means between a healthcare provider and a patient not in the same physical location. While the provision of health care services using telehealth may offer certain potential benefits, there are also potential risks associated with the use of telehealth. The telehealth services are not a substitute for in-person health care in all cases. In order to use the Service, you will be required to review and agree to informed consent regarding the use of telehealth (the “Telemedicine Consent”) provided by the Provider. You agree that New Roads Health uses a third party in obtaining Patient Consent and has the right to enforce it against you.
Prescription
Certain products available through the Site require a valid prescription by a licensed healthcare provider. You will not be able to obtain a prescription product unless you have completed a consultation with the Provider through the Site, the Provider will determine if the prescription product is appropriate for you and the Provider will send the prescription electronically. You may fill the prescription at any pharmacy of your choice as prompted during your use of the Service.
You agree that any prescriptions that you acquire from a Provider will be solely for your personal use. You agree to fully and carefully read all provided product information and labels and to contact a provider or pharmacist if you have any questions regarding the prescription. New Roads Health fully honors patient freedom of choice and, if you receive a prescription for a medication, you always have the option to instruct your Provider to transmit that prescription to the pharmacy of your choice.
Insurance
New Roads Health is not an insurer. The Services are not insurance products, and the amounts you pay to New Roads Health are not insurance premiums. You acknowledge that the Services provided by New Roads Health will not be billed to any insurer, even though they may be covered by your insurance plan. Services provided by other providers, laboratories, or pharmacies outside our Site or Practice are not bound by our policy and may bill your insurance. If you desire any type of health coverage or other insurance, you will need to purchase such insurance separately.
3. Services Availability
New Roads Health operates subject to state and federal regulations, and the Services may not be available in your state. You represent that you are not a person barred from enrolling for or receiving the Services under the laws of the United States or other applicable jurisdictions in which you may be located. Access to and use of the Site or the Services is limited exclusively to users located in States within the United States where the Services are available. Services are not available to users located outside the United States. Accessing the Site or Services from jurisdictions where content is illegal, or where we do not offer Services, is prohibited.
4. Subscriptions and Online Payments
Depending on the payment method available to and chosen by you, the fees for our services may be paid by you directly through subscription fees. We charge a subscription fee for you to use and access the Site and its features, your subscription is continuous and will be automatically renewed at the end of the applicable subscription period, unless you cancel your subscription before the end of the current subscription period by sending New Roads Health a message thru the Site, Portal or emailing us. If you cancel your subscription, your account will automatically close at the end of your current billing period. New Roads Health may change the subscription fee, from time to time and will communicate any price changes to you in advance and, if applicable, how to accept those changes. Price changes will take effect at the start of the next subscription period following the date of the price change. Subject to applicable law, you accept the new price by continuing to use the New Roads Health Services after the price change takes effect. If you do not agree with a price change, you have the right to reject the change by unsubscribing from the Services prior to the price change going into effect.
To simplify the user experience on the Site, you are able to pay for Services via the Site with New Roads Health serving as a payment processing agent on your behalf. We accept credit and debit cards issued by U.S. banks (your “payment method”). You agree that the payment method you submit may be used automatically by New Roads Health and its payment processors for any of your responsibilities for payment. If a credit card account is being used for a transaction, New Roads Health may obtain preapproval for an amount up to the amount of the payment. You agree to allow New Roads Health’s third-party payment processor to securely store your payment method. Upon enrollment in our Services, all charges and fees will be billed to the payment method you designate during the setup process. You understand and acknowledge that Services may be canceled or withheld if you revoke this authorization, and that you are still responsible for all charges incurred by you or are otherwise owed to New Roads Health. This authorization will remain in full force and effect until revoked by you or us. If you want to designate a different payment method or if there is a change in your payment method, you must change your information online. This may temporarily delay your ability to make online payments while we verify your new payment information.
You represent and warrant that if you are making online payments (a) any credit card, debit card, and bank account information you supply is true, correct, and complete, (b) charges incurred by you will be honored by your credit/debit card company or bank, (c) you will pay the charges incurred by you in the amounts posted, including, without limitation, any applicable taxes, and (d) you are the person in whose name the card was issued and you are authorized to make a purchase or other transaction with the relevant credit card and credit card information. If New Roads Health is unable to secure funds from the payment method you provide for any reason, including insufficient funds in the payment method or insufficient or inaccurate information provided by you when submitting electronic payment, New Roads Health may undertake further collection action, including the application of fees to the extent permitted by law. You acknowledge and agree that you will not dispute the charges from New Roads Health or our third-party payment processor with the payment method company, provided the transactions correspond to the terms indicated in these Terms of Use.
5. Notification with the use of Electronic Communication
When you use the Site, Products, or Services, or send e-mails, messages, and other communications from your desktop or mobile device to us, you are communicating with us electronically. You consent to receive communications from us electronically. You agree that (a) all agreements and consents can be signed electronically and (b) all notices, disclosures, and other communications that we provide to you electronically satisfy any legal requirement that such notices and other communications be in writing. New Roads Health may contact you by text, call or email to verify your information. New Roads Health may request further information from you and you agree to provide such further information to ensure that you have not fraudulently used the Services.
6. Consent to Receive Calls and Text Messages
By using the Site and providing your mobile number, you are agreeing to be contacted by or on behalf of New Roads Health including calls and text messages, to receive information related to our Products or Services (e.g.: appointment reminders, etc.); Message and data rates may apply. You may opt-out by informing us. Please note, that by withdrawing your consent, some Site features and certain Services may no longer be available to you.
7. License Use
Permission is granted to temporarily download one copy of the materials (information or software) on New Roads Health’s website for personal, non-commercial transitory viewing only. This is the grant of a license, not a transfer of title, and under this license, you may not: modify or copy the materials; use the materials for any commercial purpose, or for any public display (commercial or non-commercial); attempt to decompile or reverse engineer any software contained on New Roads Health’s website; remove any copyright or other proprietary notations from the materials; or transfer the materials to another person or “mirror” the materials on any other server. This license shall automatically terminate if you violate any of these restrictions and may be terminated by New Roads Health at any time. 9. Users Limited to 18 Years Old and Above
In order to access the Site and the Services, you represent and warrant that you are older than 18 years old. If you are under the age of 18, please do not attempt to register with us at this Site or provide any personal information about yourself to us. If we learn that we have collected personal information from someone under the age of 18, we will promptly delete that information. 10. Limitations
In no event shall New Roads Health or its suppliers be liable for any damages (including, without limitation, damages for loss of data or profit, or due to business interruption) arising out of the use or inability to use the materials on New Roads Health’s Internet site, even if New Roads Health or a New Roads Health authorized representative has been notified orally or in writing of the possibility of such damage. Because some jurisdictions do not allow limitations on implied warranties or limitations of liability for consequential or incidental damages, these limitations may not apply to you.
11. Revisions and Errata
The materials appearing on New Roads Health’s website could include technical, typographical, or photographic errors. New Roads Health does not warrant that any of the materials on its website are accurate, complete, or current. New Roads Health may make changes to the materials contained on its website at any time without notice. New Roads Health does not, however, make any commitment to update the materials. New Roads Health may revise these terms of use for its website at any time without notice. By using this website, you are agreeing to be bound by the then-current version of these Terms and Conditions of Use.
14. Governing Law
Any claim relating to New Roads Health website shall be governed by the laws of the State of Arizona without regard to its conflict of law provisions.
15. User Data and Information
Before or at the time of collecting personal information, we will identify the purposes for which information is being collected. We will collect and use personal information solely with the objective of fulfilling those purposes specified by us and for other compatible purposes unless we obtain the consent of the individual concerned or as required by law. We will only retain personal information if necessary for the fulfillment of those purposes. 16. Indemnification
You agree to defend, indemnify, and hold harmless New Roads Health and any affiliates from and against any and all rights, demands, losses, liabilities, damages, claims, causes of action, actions, and suits (no matter whether at law or equity), fees, costs, and attorney’s fees of any kind whatsoever arising directly or indirectly out of or in connection with (i) your use or misuse of the Site, Products, Services or any information posted on the Site; (ii) your breach of the Terms of Use or Privacy Policy; (iii) the content or subject matter of any information you provide to New Roads Health, your Provider, or a non-clinical staff; or (iv) any negligent or wrongful act or omission by you in your use or misuse of the Site, Products, Services, or any information on the Site, including without limitation, infringement of third party intellectual property rights, privacy rights, or negligent or wrongful conduct.
These Terms of Use incorporate the following legal documents by reference, as well as any other policies or procedures referenced herein that are posted to the New Roads Health Site from time to time. Some documents may or may not be posted to the Site and can be shared with you by electronic communication.
